1. What information do we collect?

AMResorts® may collect (i) Personal data, such as your name, date of birth, home address, work address, social security number, economic dependents, telephone numbers, electronic mail (e-mail), unique population registry, work, and personal references and (ii) data related to the study and exercise of your profession. The above-mentioned data will be referred to hereunder as the “Personal Data”.

All Personal Data will be safeguarded with the necessary technical, administrative, and physical security measures to ensure its protection.

2. What do we use your information for?

The Personal Data we collect is solely for the following purposes: i) Inventory and personnel information; ii) Statistical purposes; iii) To eventually be able to contact you for any job opportunities and for any internal or external audit; iv) Preparation of labor certificates or notices of sanctions or dismissal; v) Updating personal data through the preparation of socioeconomic studies that are carried out periodically; vi) Management of labor benefits of the company such as insurance that is in force, vii) Contracting of professional services that the company requires in its Outsourcing modality, with national or foreign companies, third parties or the Group, for the management of information .

We collect and treat your Personal Data in accordance with the principles of legality, quality, consent, information, purpose, loyalty, proportionality, and responsibility, established in the Mexican Law.

3. With whom do we share your information?

AMResorts® may transfer your Personal Data only to companies belonging to the corporate group to which AMResorts® belongs, as well as to selected third-party service providers that enter contracts for the provision of outsourcing services or, for the fulfillment of their employer obligations. In no case will we market, sell or rent your Personal Data to a third party without obtaining your prior consent.

The Personal Data that you provide to the HOTEL may be compiled and filed in a database owned exclusively by AMResorts®.

4. What security and control measures do we use to protect your Personal Data?

AMResorts® has implemented administrative, technical, and physical security measures to protect your Personal Data against damage, loss, alteration, destruction, use, access, or unauthorized treatment, which we also require to be fulfilled by the service providers we hire, even when dealing with of services provided by subsidiary or affiliated companies of AMResorts®.

Unfortunately, AMResorts® cannot guarantee that any data transmission or storage system is 100% secure. If you suspect that your interaction with us is no longer secure, please notify us immediately using the information in section 6 of this Privacy Notice.

5. Who is in charge or area responsible for the processing of Personal Data?

The area responsible for the processing of Personal Data in AMResorts® is the “Human Resources Department” with address at Unit A-1, Centro Empresarial Cancún, Lote 18-12, Mza52, Hotel Zone, Cancun, Quintana Roo, Mexico, 77500, with business hours are from 9:00 a.m. to 6:00 p.m. Monday to Friday, with the email address mentioned in number 6 of this Privacy Notice and with a telephone number (+52) (998) 8914646.

6. How can you exercise your ARCO rights and revoke your consent to treatment?

Users who own the Personal Data may exercise their ARCO rights (access, cancellation, rectification, and opposition to their processing) or revoke the consent they have granted to AMResorts® for the processing of their Personal Data, directly sending their request via email to pdpamr@amresorts.com. Said request must contain at least: (a) name and address or other means to communicate the response to your request; (b) the documents that prove your identity (c) the clear and precise description of the Personal Data with respect to which you are requesting to exercise any of the ARCO rights, and (d) any other element that facilitates the location or identification of the Data Personal.

7. When can you exercise your ARCO rights?

In terms of the Law and the regulations, at any time you may submit a request to us to exercise your ARCO rights. AMResorts® must answer your request within 20 days from the date of receipt of the request. If after the term indicated by the Law, AMResorts® does not respond to your request, then you can initiate the ARCO rights protection procedure before the Federal Institute of Access to Information and Data Protection (IFAI).
